Coronavirus: New Statutory Sick Pay Regulations

Coronavirus: New Statutory Sick Pay Regulations

The Statutory Sick Pay (General)(Coronavirus Amendment) Regulations 2020 have now been drafted and come into force this week.

Originally, only those people who had been advised by their GP or NHS 111 to self isolate due to their symptoms would be eligible for Statutory Sick Pay (SSP), however these new Regulations provide that SSP will be available to anyone isolating themselves from other people in such a manner as to prevent infection or contamination with coronavirus, in accordance with guidance published by Public Health England, NHS Scotland or Public Health Wales.

We are still awaiting the anticipated Regulations providing that SSP will be payable from day 1 (not day 4 as is currently the situation), and allowing employers to reclaim the cost from the Government and we will update you once we have seen those Regulations.
