Sold your house, but the old mortgage (Standard Security) is still on your title deeds? Learn about the Scottish court application process to have it formally removed.
You’ve sold your property, paid off your mortgage (or other loan), and moved on. But when you check your Land Certificate, you notice an unwelcome ghost from the past: your old Standard Security is still registered against the title.
This is a common issue in Scotland. A Standard Security is the legal document that secures a mortgage against your property. While your lender should automatically discharge it once the loan is repaid, sometimes things fall through the cracks – especially with older loans, lenders who have merged, or those that have ceased to exist.
Leaving an obsolete security on your title can cause problems down the line, potentially complicating a future sale or remortgage. So, how do you get rid of it? The answer often lies in a formal application to the Scottish courts.
Typically, when you repay your mortgage, your lender is obliged to issue a Discharge of Standard Security. This document is then sent to the Registers of Scotland to formally remove the security from the title – our conveyancing team assist with this. However, you might need to take matters into your own hands if:
When you cannot obtain a discharge through the normal channels, the Conveyancing and Feudal Reform (Scotland) Act 1970 provides a solution. This Act allows a property owner to apply to the Court for an order to remove the security.
This isn’t a court action against the lender. Instead, it’s a formal request for the court to use its power to “rectify” the Land Register by ordering the Keeper to remove the outdated security.
The evidential burden remains that the Sheriff needs to be satisfied that the standard security should be discharged because the mortgage or the loan was fully repaid. In that regard, it is important that you provide as much information and evidence that you can. If you are selling your property, it is also important to get this process started as early as possible to ensure any agreed date of entry can be adhered to.
If you find yourself in this position, we can assist in assessing your case, gathering the necessary evidence, and guiding you confidently through the court process to achieve a clear title and secure the marketability of your most valuable asset.
