Why Early Legal Advice Can Prevent Costly Litigation
Paul Madden

As commercial litigators, investors and creditors often engage our services after it has effectively become too late to avoid a Court process. It is common for litigators to think “if only we were engaged at an earlier stage” while in the process of taking initial instructions.

We get it. Litigation can be expensive. It can be timely and for most people, it can be stressful. It is also understandable for investors or creditors to seek to resolve the issue without engaging litigators. Litigation must surely be the last resort. Indeed, there is also the valid argument that litigation must be the last resort, and the Courts should not reward aggressive actors barreling the parties into an avoidable action.

But here is the counterargument for seeking legal advice at a much earlier stage. By engaging the right firm, your lawyer (whether they describe themselves as a litigator, advisor, or dispute resolution solicitor) will be better placed to protect or assert your rights and, therefore, might be able to stop the wrongdoing, or potential breakdown of trust between the parties. The medical profession uses the term “prevention is better than cure” and by analogy, earlier engagement with your lawyer can often avoid the need for Court intervention.

At Gilson Gray, we provide practical and sensible advice which is focused on solutions. We understand that litigation should be the last resort but the best way of avoiding that litigation is to engage us sooner and before the relationship has broken to the extent it is no longer feasible for the parties to agree a consensual resolution.
