The annual increase to Vento Bands

‘Vento bands’—a game-changer when it comes to assessing compensation for injury to feelings and psychiatric injury in discrimination and whistleblowing cases. In this blog, Stuart Robertson unravels the vital updates in this annual review.

According to the esteemed Equality and Human Rights Commission, discrimination cases have seen a wealth of case law surrounding the appropriate levels of injury to feelings. While there is no formal limit on court awards, the senior appeal courts have established the renowned ‘Vento scale’—a range of awards for injury to feelings.

The Presidents of the Employment Tribunal diligently review and increase the Vento band limits every year. For claims presented on or after 6 April 2024, here’s what you need to know:

  • A lower band ranging from £1,200 to £11,700 covers less serious cases.
  • A middle band spanning £11,700 to £35,200 embraces cases that don’t merit an award in the upper band.
  • An upper band stretching from £35,200 to £58,700 accommodates the most serious cases, with exceptional scenarios capable of exceeding £58,700.
