Good News for Commercial Landlords

There is finally some good news on the horizon for commercial landlords. For almost two years now they have required to give 14 weeks’ notice to defaulting tenants before they could terminate the lease for non-payment of rent. That was as a result of a number of Coronavirus protections introduced during the pandemic. As of 29th March 2022 however, that notice period will be reduced to the normal 14 days as a result of the Coronavirus (Scotland) Act (Early Expiry and Suspension of Provisions) Regulations coming into force on that date. This will be good news to commercial landlords who have tenants in rent arrears. It will enable them to recover possession of their property quicker than at any time in the past two years.

Any notices served before 29th March 2022 will still be bound by their 14 week notice period. The regulations do not act retrospectively. Landlords may still be able though to serve fresh notices on the new 14 day period, for any fresh arrears that might have fallen due since any historic notices.
